By accessing or using our website, file upload infrastructure, encryption tools, and transfer links (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before uploading any data to our network.

1. Acceptance of Terms

By creating an account, subscribing to a plan, or uploading files through GoMon, you represent that you are at least 18 years old and legally competent to enter into this agreement. If you are using the Services on behalf of a business or corporate entity, that entity accepts these Terms.

2. Description of Services

GoMon provides a secure, encrypted file transfer service designed to let users upload, store temporarily, and share digital files. GoMon utilizes advanced encryption protocols. GoMon reserves the right to modify storage architecture, bandwidth limits, and link expiration mechanisms at any time.

3. Account Tiers: Free Accounts and Paid Subscriptions

We offer different operational tiers based on file size limitations, storage duration, and security features:

  • Free Accounts: GoMon provides a basic file sharing tier free of charge ("Free Account"). Free Accounts are subject to strict limitations, including maximum file upload sizes (e.g., up to 2GB per transfer), automatic link expiration (e.g., deletion after 7 days), and capped download bandwidth. GoMon reserves the right to terminate inactive Free Accounts.
  • Paid Subscriptions: Users can upgrade to a "Paid Subscription" to unlock significantly higher or unlimited file size capacities, custom expiration dates, password protection, long-term cloud storage, tracking metrics, and white-labeled transfer pages.

4. Content Responsibility and Acceptable Use

GoMon operates as a conduit for your data. Because we respect your privacy and utilize zero-knowledge principles where technical setups allow, **you are solely responsible** for the contents of the files you transmit. You strictly agree not to use the Services to upload, share, or distribute:

  • Files that infringe upon third-party intellectual property rights, copyrights, or patents.
  • Illegal material, malware, ransomware, spyware, or viruses designed to disrupt computing infrastructure.
  • Content that facilitates fraud, identity theft, or violates localized criminal legislation.

GoMon reserves the right to immediately remove files and terminate accounts if we receive valid legal notices (such as DMCA takedown requests) or discover systemic abuse.

5. Billing, Cancellations, and Data Deletion

The following provisions govern users holding Paid Subscriptions:

  • Subscription Fees: Premium plans are billed in advance on a recurring monthly or annual cycle.
  • Downgrades and Automatic Purging: If you cancel your Paid Subscription or downgrade to a Free Account, your storage capacity will shrink instantly. Any active file transfers or stored data exceeding the free tier's strict caps will be **permanently and irreversibly deleted** from our storage nodes. GoMon is not liable for data loss resulting from plan downgrades.
  • Refund Policies: Payments are non-refundable for partially used billing periods, unless required by local consumer protection laws.

6. Security and Zero-Knowledge Disclaimer

While GoMon deploys industry-leading security practices to isolate and protect your data payloads, you acknowledge that:

  • If you utilize custom end-to-end password encryption and **lose your encryption password**, GoMon cannot recover the password or decrypt your files. Your data will be permanently inaccessible.
  • No digital transmission or storage infrastructure over the internet is completely impregnable. GoMon provides no absolute guarantee against highly sophisticated cyber-attacks or data breaches.

7. Limitation of Liability

To the maximum extent permitted by law, GoMon and its developers shall not be held liable for any direct, indirect, incidental, special, or consequential damages. This includes, without limitation, **loss of data, business disruption, loss of commercial profits, or legal consequences** resulting from the unauthorized interception of transfers, accidental file deletion, server downtime, or the actions of recipients you share transfer links with.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any legal actions or disputes arising under these Terms will be settled exclusively within the competent courts of the jurisdiction where GoMon is established.
